General Terms of Use
for End Customers of Dokumentale - International Documentary Film and Media Festival Berlin
1. Subject of the Contract
Good Media Network GmbH ("GMN") organizes and hosts the Dokumentale - International Documentary Film and Media Festival ("Dokumentale").
As part of this festival, GMN GmbH offers various paid and free tickets for events. In addition, video-on-demand services are provided, allowing selected films and other audiovisual content to be accessed either for a fee or free of charge.
It is also possible to purchase passes, which may be either paid (Festival Pass, 5 Film Select Pass, Accreditation) or free (for invited guests and partners). These passes allow for the ordering of free event tickets and the free booking of video-on-demand services.
Unless otherwise specified, GMN GmbH is responsible as the organizer of all offered events.
2. Scope
(1) The following general terms and conditions ("AGB") apply to the legal relationship created by the purchase and/or use of admission tickets ("Ticket(s)") from GMN or authorized third parties ("authorized sales points"), especially for attending events within the scope of Dokumentale.
(2) The end customer acknowledges that GMN utilizes third-party services in connection with attending events and using the video-on-demand service, particularly the company "eventive" and payment providers, whose terms of use apply alongside the organizer’s terms. In case of conflicting terms, the third-party terms take precedence.
3. Schedules and Start Times, Changes
The valid schedules with start times can be found in the official publications of Dokumentale and online at www.dokumentale.de. Schedule changes are reserved. No guarantee is provided for the accuracy of times or the appearance of announced guests/speakers.
4. Tickets
(1) General
Access to screenings is only possible with a valid ticket. No tickets guarantee a specific seat. Seats in the cinema should be taken shortly before the event begins. Tickets can be purchased in advance for the entire festival duration.
Tickets for all screenings are available both at the cinema box offices and online at www.dokumentale.de.
GMN reserves the right to exclude individual screenings from online sales and, in justified cases, to limit the number of tickets available per customer.
The offer to participate in Dokumentale events without an indicated age restriction is aimed at persons aged 18 and above.
Festival passes, accreditation entitlements, and individual tickets based on a festival pass or accreditation are personal and non-transferable.
(2) Ticket Categories
Single Event Tickets: Regular and Discounted Tickets. Discounted tickets are available for students, trainees, participants in voluntary social or political service years, retirees, and unemployed individuals, as well as visitors with disabilities from the first degree of disability upon presentation of a disability ID. There is no claim to a specific seat for the event.
(Early Bird) Festival Pass: Grants access to all public events (excluding D’Hub and invitation-only events) and to all streams via Eventive. Per pass, one ticket can be booked per event, and each film available on Eventive can be streamed once. A personal code will be sent to the end customer with the delivery of the Festival Pass. Despite the pass, it is still necessary to book tickets for the corresponding events. By entering the personal code, the ticket price will be adjusted. Without a valid ticket, access to events is denied. GMN points out that only a selection of films and not the entire program is available as VOD content via Eventive. Detailed information on which films are available as VOD content can be found at www.dokumentale.de.
(Early Bird) 5 Films Select Pass: Grants access to five selected public events (excluding D’Hub and invitation-only events) and five streams via Eventive.Per pass, one ticket can be booked per event, and one film can be streamed once. The pass allows tickets for five films and the streaming of five films via Eventive. A personal code will be sent to the end customer with the delivery of the Festival Pass. Despite the pass, it is still necessary to book tickets for the corresponding events. By entering the personal code, the ticket price will be adjusted. Without a valid ticket, access to events is denied. GMN points out that only a selection of films is available as VOD content via Eventive. Further details are available at www.dokumentale.de.
Accreditation: Grants access to all D’Hub events and 10 selected public events, as well as 10 film streams via Eventive. Per pass, one ticket can be booked per event, and each film on Eventive can be streamed once. A personal code will be sent to the end customer with the delivery of the Festival Pass. Despite the pass, it is still necessary to book tickets for the corresponding events. By entering the personal code, the ticket price will be adjusted. Without a valid ticket, access to events is denied.
(3) Discounts
GMN offers discounted tickets to certain persons and/or groups. GMN will provide timely information on which persons and/or groups are eligible for discounts. The eligibility for discounts is determined by the date of the event for which a ticket is purchased. The current official discount proof must be carried when entering the event venue and presented upon request.
Eligible for discounts are persons over 65, students, trainees, national volunteer service members, unemployed individuals, and refugees upon presentation of the appropriate proof. Visitors with disabilities receive tickets at a reduced price from the first degree of disability upon presentation of a disability ID.
If the disability ID includes the "B" (companion) note, the eligible person can bring a companion to the booked event for free. Please contact us in advance via email: mail at thegoodmedia.net.
(4) Cinema Ticket Sales
The respective terms and conditions of the cinemas apply to the purchase of tickets at cinema box offices.
(5) Online Ticket Sales/Contract Conclusion
To conclude a contract between GMN and the end customer for attending an event (hereafter "Event Contract"), full and accurate input of the data requested by GMN in the provided input form is required for an online contract conclusion.
By clicking the "Order with Payment" button, the end customer makes a binding offer. The contract between GMN and the end customer is only concluded upon the electronic dispatch (via email) of the ticket by GMN, based on these terms and conditions (AGB).
(6) Video-On-Demand
The video-on-demand content is provided via our partner Eventive (www.eventive.com).
GMN points out that only a selection of films and not the entire program is available as VOD content via Eventive.
(7) Right of Withdrawal
Even if GMN offers tickets via means of distance communication as defined in § 312c para. 2 of the German Civil Code (BGB) and a distance contract may exist under § 312c para. 1 BGB, no right of withdrawal exists under § 312g para. 2 no. 9 BGB when purchasing a ticket. This means that the two-week withdrawal and return right does not apply. Every ticket offer or order is binding immediately upon electronic dispatch by GMN and obliges the customer to accept and pay for the ordered tickets. Exchanges and refunds are generally excluded.
5. Rescheduling, Cancellation, and Termination
(1) Rescheduling
GMN reserves the right to reschedule events or parts of events and to make program changes. In all cases, purchased tickets for rescheduled events or parts of events remain valid, but entitle the customer to withdraw from the contract for the affected event or part. The affected customer must declare their withdrawal in text form (email is sufficient), by fax, or in writing via mail. The affected customers will be refunded the ticket price upon presentation of the original ticket. The final scheduling of an event is not considered rescheduling and does not entitle the customer to withdraw if the final scheduling was not determined at the time of ticket purchase.
(2) Cancellation and Audience Exclusion
In the event of cancellation, the ticket price will be refunded at face value upon presentation of the original ticket within fourteen (14) working days after the event date, provided that bank details are given.
(3) Termination and Event Repetition
In case of event termination, no refund of the ticket price is due unless GMN is responsible for the termination. In the case of event repetition (i.e., rescheduling of a started but terminated event), the repetition is considered a new event; the ticket for the original event is not valid unless GMN expressly indicates that it is valid for the repetition. If the ticket remains valid, the customer may withdraw from the contract. The affected customer will be refunded the ticket price upon sending the ticket to GMN.
6. Use and Transfer
(1) Right of Access
GMN intends to grant access to the event only to those ticket holders who purchased tickets from GMN or an authorized sales outlet or who obtained them through an authorized transfer. The right of access ends with the first exit from the event venue. If a ticket was obtained through unauthorized transfer, there is no right of access. In this case, GMN reserves the right to refuse entry. Claims against GMN in this case are excluded. The customer must carry official identification (e.g., ID card) and present it upon request.
(2) Transfer Restrictions
To prevent violence and crime in connection with attending the event and to prevent unauthorized ticket resale, especially ticket speculation, GMN and the audience have an interest in restricting ticket transfer.
(3) Unauthorized Transfer
If personalized tickets have been issued, any commercial or business resale of tickets by the customer is prohibited. The customer is especially prohibited from:
- Publicly offering or selling tickets, particularly at auctions or on the internet (e.g., on eBay, eBay Kleinanzeigen) and/or on unauthorized platforms (e.g., Viagogo, StubHub);
- Selling tickets at a price higher than the purchase price; a surcharge of up to 10% to cover transaction costs is permissible;
- Selling tickets to commercial resellers or ticket brokers;
- Selling tickets to persons with a venue ban, provided the customer knew or should have known about the ban;
- Using tickets commercially without GMN’s explicit prior written consent, especially for advertising, marketing, as a bonus, as a promotional gift, as a prize, or as part of unauthorized hospitality or travel packages.
If there is one or more violations of the rules in paragraph (3) and/or other unauthorized ticket transfers, GMN is entitled to withhold delivery of the affected tickets, cancel them, and deny the ticket holder entry to the venue without compensation or expel them.
(4) Permitted Transfer
A private, non-public transfer of a ticket for non-commercial reasons, especially in the event of illness or other hindrance of the customer, is permitted if no unauthorized transfer as defined in paragraph 6 (3) occurs. Additionally, the new ticket holder must (i) be informed of the terms and conditions of the AGB and the need to provide information (e.g., first and last name) to GMN and (ii) agree to the AGB by acquiring and using the ticket. GMN must also be informed in advance of the ticket transfer, or GMN must expressly declare the transfer as permissible. The transfer of discounted tickets follows the same rules, with the additional requirement that the new ticket holder meets the discount eligibility criteria.
7. Behavior at the Event Venue
(1) House Rules
GMN or designated third parties retain the right to enforce house rules at any time. Customers must always comply with the instructions of GMN, the police, and security personnel before, during, and immediately after the event.
(2) Admission
Every customer or ticket holder with a valid ticket is generally entitled to enter the event venue. However, access may be denied, or the customer may be removed from the venue if:
- The customer refuses to undergo a reasonable security check at the entrance or within the venue;
- The identifying features on the tickets (e.g., name, seat details, barcode, QR code, serial and/or cart numbers) have been manipulated, made unreadable, or damaged, or if an attempt to use the ticket has already been made, unless this is the fault of GMN. Furthermore, the ticket holder must match the person whose information is associated with the ticket unless it’s a case of permitted transfer as defined in paragraph 5 (4);
- The customer appears visibly intoxicated or under the influence of drugs;
- The customer brings or uses prohibited items such as glass containers, drones, pyrotechnics, torches, weapons, or other dangerous items, or animals.
If entry is rightfully denied, the customer is not entitled to compensation.
It is also prohibited to carry or use the following items: racist, xenophobic, right- or left-wing extremist propaganda, political or religious items of any kind, including banners, signs, symbols, and flyers, if there is reason to believe they will be displayed inappropriately at the venue. Independent of items being carried, any utterance or spread of inhumane, racist, xenophobic, politically extremist, obscene, provocative, or insulting messages, as well as related actions, are forbidden throughout the venue.
(3) Liability
Attendance at the venue is at your own risk. GMN and/or its agents are only liable for damages, regardless of the legal grounds, in cases of intent or gross negligence or – then limited to the foreseeable, typical contractual damage at the time the contract was concluded – in the case of the breach of essential contractual obligations. Essential contractual obligations are those whose fulfillment enables the proper execution of the contract, whose breach endangers the achievement of the contract’s purpose, and on whose compliance the customer regularly relies. This liability limitation does not apply to claims for damages due to injury to life, body, or health or due to other legally mandatory grounds. Liability for stolen or lost items is excluded.
(4) Photo/Video Recording
Presence at the venue for media coverage of the event (TV, radio, internet, print, photography) is only allowed with GMN's consent and in designated areas. Without GMN’s consent, it is not permitted to record sounds, photos, images, descriptions, or results/data of the event unless solely for private, non-commercial use. GMN and/or authorized third parties (e.g., press) may independently record and process images and footage showing the audience for reporting and promotion purposes under Article 6 (1)(f) DS-GVO.
8. Data Protection
Unless otherwise specified in these terms and conditions, personal data of the customer and/or ticket holder is processed to fulfill a contract between GMN and the customer or between the customer and the ticket holder under Article 6 (1)(b) DS-GVO. Additionally, the processing of data serves the legitimate interests of GMN. Further data protection provisions and the rights of ticket holders can be found in the privacy policy, available at www.dokumentale.de.
9. Changes and Amendments
GMN is entitled to amend and/or supplement these AGB and/or the price list with a notice period of four (4) weeks in advance due to changes in market conditions, the law, or court rulings, provided this is reasonable for the customer. The customer will be informed of the respective changes in writing or, if the customer has agreed to this form of correspondence, via email. Changes or amendments are deemed approved if the customer does not object in writing or by email within four (4) weeks after receiving the changes, provided GMN has expressly pointed out this approval fiction in the change notification.
10. Final Clause
If individual provisions of these AGB are wholly or partially invalid, the validity of the remaining provisions or the remaining parts of such provisions shall not be affected. The parties shall replace an invalid provision with a provision that comes closest to the economic purpose of the invalid provision. The same applies in the event of a gap in these AGB.
In the event of disputes over the interpretation of regulations, the German-language version shall prevail in case of doubt.
