General Terms of Use for Customers
of the Dokumentale - International Documentary Film and Media Festival Berlin
1 Subject Matter of the Contract and Definitions of Terms
Good Media Network GMN GmbH (hereinafter "Organizer") organizes and hosts the Dokumentale - International Documentary Film and Media Festival Berlin (hereinafter "Dokumentale"). Within the framework of this festival, the Organiser offers end customers (hereinafter referred to as "Customer") various paid and free tickets for events during the Dokumentale (10th Dokumentale (10th - 20th October at various locations in Berlin).
2 Scope of the Terms of Use
These Terms and Conditions of Use shall apply to all events organised by the Event Organiser within the framework of the Dokumentale. Deviating or additional terms and conditions of the end customer shall only apply if they have been confirmed in writing by the Organiser. The Organiser is entitled to use the services of third parties whose terms and conditions apply in addition to these Terms and Conditions.
3 Ticket Purchase
As soon as the required data has been entered and the "Pay" button has been clicked, i.e. a ticket has been purchased, the contract for participation in an event is concluded. A valid ticket is required for admission to the performances. There are no tickets that guarantee the use of a particular seat. Reduced tickets are available for students, volunteers, trainees, unemployed people, and interns.
4 Obligations of the Costumer
The end customer agrees to provide accurate information. Filming and recording of film screenings are prohibited and may result in legal action. Failure to comply may result in being prosecuted.
5 Remuneration and Payment Conditions
The end customer is obliged to pay the agreed remuneration in accordance with the terms and conditions of payment. Payment may only be effected using the approved methods of payment. Payment shall also be due in the event of use by third parties if the customer is responsible for this use.
6 Ticket Refund
Returning or exchanging tickets already purchased is generally not possible. In the event that an event is cancelled, the cost of the ticket will be refunded. There is no right of withdrawal according to ยง 312g para. 2 no. 9 BGB (German Civil Code) for the purchase of tickets for events.
7 Contract Language
The languages available for concluding contracts are German and English. In the event of any ambiguity in the interpretation of the contractual provisions, the German-language version shall be binding.
8 Online Dispute Resolution, Dispute Resolution
The European Commission provides an online platform for the out-of-court settlement of consumer disputes which can be accessed at http://ec.europa.eu/consumers/odr/ . The organiser does not participate in any dispute resolution procedure before a consumer arbitration board within the meaning of the VSBG and is not obliged to do so. 9 Final Provision
The law of the Federal Republic of Germany shall apply to the exclusion of the CISG. Should any provision of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining General Terms and Conditions.The Organiser is entitled to amend these General Terms and Conditions for objectively justified reasons (e.g. changes in case law, the legal situation, market conditions or business or company strategy) and subject to reasonable notice.Existing customers will be notified by e-mail at least two weeks before the amendment comes into effect.
If the existing client does not object within the time limit specified in the notification of the change, he shall be deemed to have agreed to the change; if he objects, the changes shall not come into effect; in this case, the contractor shall be entitled to terminate the contract extraordinarily at the time the change comes into effect. The notification of the intended change to these general terms and conditions shall refer to the time limit and the consequences of an objection or failure to object.
